POWER OF ATTORNEY, REVOCATIONS AND SUBSTITUTIONS, CERTIFIED COPIES

There are two types of power of attorney: Special Power of attorney and General Power of attorney, both of which are found in Title XI of the Civil Code of Venezuela.

Special Power of Attorney

Is for a specified matter or business of the grantor in Venezuela.

Requirements:

  • The power of attorney document must be written in conformity to the requirements of Venezuelan law (advice from a Venezuelan lawyer is suggested).
  • The power of attorney document should be written in Spanish, on legal-sized paper and double-spaced.
  • Prior to finalizing the power of attorney document, the interested party should send document via e-mail (consular@venezuela-us.org) in order to determine consular rights and set up an appointment for signing the document in the Consular Section, and a copy of identity card (if Venezuelan) and / or other identity documents in the case of foreigners.
  • The original document should be presented.  Faxes and copies are not accepted and it should not have been previously signed or notarized.
  • The power of attorney document should be signed in the presence of a Consular official, at which time a money order made out to “Embajada de Venezuela” for one hundred dollars ($100) should be presented.
  • At the time of the signing , the applicant must bring his/her laminated identity card (in case of Venezuelans) or other kind of  id  (for foreigners).

General Power of attorney

Grants full rights for administration and management of all of the grantor’s goods, for all of the grantor’s matters or businesses in Venezuela.

Requirements:

  • The power of attorney document must be written in conformity to the requirements of Venezuelan law (advice from a Venezuelan lawyer is suggested).
  • The power of attorney document should be written in Spanish, on legal-sized paper and double-spaced.
  • Prior to finalizing the power of attorney document, the interested party should send document via e-mail (consular@venezuela-us.org) in order to determine consular rights and set up an appointment for signing the document in the Consular Section, and a copy of identity card (if Venezuelan) and / or other identity documents in the case of foreigners.

  • At the time of the signing , the applicant must bring his/her laminated identity card (in case of Venezuelans) or other kind of  id  (for foreigners).

Revocations and Substitutions

Requirements:

  • The same requirements and costs associated with powers of attorney, whether general or special.  Furthermore, a copy of the original power of attorney document to be revoked or substituted must be presented.

Certified Copies

Requirements:

Certified copies of documents certified by the Consular Section, including power of attorney documents, should be requested in writing.  The letter should include the number of the act, papers, book or tome and the date in which the document was awarded.  The cost of certified copies is eighty dollars ($80) per document.

Observations:

  • If power of attorney is granted for a business or firm, the original registration and constitutive act of the firm, as well as a photocopy, must be presented.
  • If power of attorney is granted for another person, the original power of attorney must be presented.
  • Every power of attorney relating to minors, social security or marriage is exempt from consular fees.
