12.1 What is a non-objection letter?
According to Section 212 E of the Law of Immigration and Naturalization, students and professionals who enter exchange student programs in the United States for studies or internships (J-1 type visas) are required to return and reside in the country of origin for two years upon ending the studies or internship.

When the interested party wishes to extend her or his stay in the United States and wants to change visa status, the United States Information Agency (USIA) requires a “non-objection letter” regarding a change in status from government representatives of the party’s country of origin.

12.2 Requirements
To begin the non-objection letter process, the interested party must bring to this Consular Section, the following documents:

  1. Write a letter addressed to the Embassy of Venezuela in Washington, D.C.  This letter must include:
    • The reasons why the party is requesting a non-objection letter.
    • The party’s complete name and identification card number.
    • The party’s place and date of birth.
    • The party’s address and telephone number in the United States and Venezuela.
    • The case number as assigned by the State Department (Add form: “THIRD PARTY BARCODE PAGE”)
  2. Attach, along with the letter, the following documents:
    • A copy of the party’s Venezuelan passport, including any pages stamped with entry visas to the United States.It is also required a copy of the Venenuelan ID (cédula de identidad)
    • Original and completed IAP-66 forms (pink pages), including information describing the exchange program, the corresponding number and the sponsoring organization.
    • Authorization from the sponsoring organization is required, indicated that no financial commitments remain pending and that there are no impediments for a change of visa status or objection in obtaining a permanent residency in the United States.  Furthermore, a letter from the sponsor should be presented in which the sponsor exonerates the party from their obligation to return to Venezuela to offer their services for a period of two years.
    • If the study program was financed by the party, a letter from the educational institution attesting to this fact is required.
    • A stamped envelope for the return of the original documents.
