MEASURES BEFORE CADIVI (THE COMMISSION OF FOREIGN EXCHANGE ADMINISTRATION IN VENEZUELA)

The current Measures from the Commission of Foreign Exchange Administration in Venezuela (CADIVI) for Family Remittances, Students and Retired personnel, are the following:

- Measure No. 096. Related to Remittances to Relatives Living Abroad, issued by the Commission of Foreign Exchange Administration in Venezuela (CADIVI) on 05/28/2009, and published in the 05/29/2009, issue of the Official Gazette No. 39.189. For identification purposes, the Venezuelan beneficiary must go before the CADIVI authorities and present:

1. Copies of Passport;

2. Original Consular Registry Record;

3. Birth Certificate;

4. Proof of Residency (Statement of Residency) issued by the local governing authority, properly “certified” or Authenticated by the Consular Representation of Venezuela. In the event that the beneficiary is underage, enclose a copy of the Proof of Residency of the representative.

For current measures, the foreign beneficiary should go before the authorities of CADIVI and present:

1. Legal instruments of identification;

2. Proof of Residency (Statement of Residency) issued by the local governing authority, properly “certified” or Authenticated by the Consular Representation of Venezuela. In the event that the beneficiary is underage, enclose a copy of the Proof of Residency of the representative.

- Measure No. 055. Related to Student Academic Coursework abroad, issued by CADIVI on 07/13/2004, and published in the 07/13/2004, issue of the Official Gazette, No. 37.979.

- Measure No. 019. Related to Retirees or Pensioners abroad, issued by CADIVI on 04/01/2003, and published in the 04/01/2003, issue of the Official Gazette No. 37.662.

CONSULAR REGISTRY RECORD CERTIFICATES FOR MEASURES BEFORE CADIVI (ONLY FOR RESIDENTS IN THE DISTRICT OF COLUMBIA AND THE STATES OF VIRGINIA, MARYLAND, WEST VIRGINIA, OHIO AND KENTUCKY)

A. CONSULAR REGISTRY RECORD CERTIFICATE–REMITTANCE TO RELATIVES RESIDING ABROAD.

Measure No. 096. Related to Remittances to Relatives Residing abroad, issued by the Commission of Foreign Exchange Administration in Venezuela (CADIVI) on 05/28/2009, and published in the 05/29/2009, issue of the Official Gazette No. 39.189.

Requirements:

1. Complete the “Consular Registration Certificate” form for Familial Remittance.

2. Complete the “Venezuelan Registry” form

3. Legible photocopies of ID card.

4. Legible photocopies of the passport’s first page and of the extension, if applicable; additionally, a photocopy of the birth certificate in the case of undocumented minors.

5. Photocopies of two documents that show: (A) Residence (driver’s license and utility bill that contains the applicant’s name and address) and (B) Citizenship status (visa, green card, first page of American passport or any documentation of the USCIS).

PROCEDURE BY MAIL: All Consular Registry Record forms are free and can be sent via mail. To send by mail, enclose the following: full documentation and a prepaid envelope with your address to return the documents.

B. CONSULAR REGISTRY RECORD CERTIFICATE—STUDENT ACADEMIC ACTIVITIES ABROAD

Measure No. 055. Issued by CADIVI on 07/13/2004, and published in the 07/13/2004, issue of the Official Gazette No. 37.979.

Requirements:

1. Must be a student or enrolled in some type of academic coursework in the District of Columbia or in the states of Virginia, Maryland, West Virginia, Ohio and Kentucky.

2. Complete the Consular Registry Record Certificate student form.

3. Complete the Venezuelan Registry Record form.

4. Original Studies certificate for the corresponding period or a Letter of Acceptance from the educational institution, including the total registration amount. The certificate should be signed by a notary and subsequently presented before the corresponding Court to be legalized in the Consular Section. If the original Certificate has been Authenticated, the legalization is not necessary.

5. A photocopy (legible) of the ID card and the first page of the passport and extension, if applicable (both legible).

6. Photocopy of the student visa.

7. Photocopy of the I-20.

In the case of students with spouses or domestic partners:

1. Complete the form Consular Registry Record for Students (Spouse or domestic partner);

2. Marriage license or domestic partner certificate;

3. ID cards of the husband or wife, or of the domestic partner—whichever is applicable—(identification certificate and/or passport).

C. CONSULAR REGISTRY RECORD CERTIFICATE—RETIREES OR PENSIONED RESIDENTS ABROAD

Measure No. 019 issued by CADIVI on 04/01/2003, and published in the 04/01/2003, issue of the Official Gazette No. 37.662.

Requirements:

1. Complete Consular Registry Record—Retiree or Pensioned form for pensioned or retired personnel.

2. Complete the Venezuelan Registry form.

3. Photocopies of ID card (legible).

4. Photocopies of the first page of the passport and extension, if applicable (both legible).

5. Photocopies of two documents that show: (A) Proof of residence (driver’s license and utility bill that contain the applicant’s name and address) and (B) migratory Status (visa, green card, first page of American passport, or any notification of the USCIS.

6. Power of attorneys (Special Power of attorney, General Power of attorney, Revocations and Substitutions, Certified Copies)

Two types of power of attorney exist: Special Power of attorney and General Power of attorney, both of which are found in Title XI of the Civil Code of Venezuela.

  • Special Power of attorney: Is for a specified matter or business of the grantor in Venezuela.

Requirements:

  • The power of attorney document must be written in conformity to the requirements of Venezuelan law (advice from a Venezuelan lawyer is suggested).
  • The power of attorney document should be written in Spanish, on legal-sized paper and double-spaced.
  • Prior to finalizing the power of attorney document, the interested party should send document via e-mail (consular@embavenez-us.org) in order to determine consular rights and set up an appointment for signing the document in the Consular Section.
  • The original document should be presented. Faxes and copies are not accepted and it should not have been previously signed or notarized.
  • The power of attorney document should be signed in the presence of a Consular official, at which time a money order made out to “Embajada de Venezuela” for one hundred dollars ($100) should be presented.
  • General Power of attorney: grants full rights for administration and management of all of the grantor’s goods, for all of the grantor’s matters or businesses in Venezuela.

Requirements:

  • The power of attorney document must be written in conformity to the requirements of Venezuelan law (advice from a Venezuelan lawyer is suggested).
  • The power of attorney document should be written in Spanish, on legal-sized paper and double-spaced.
  • Prior to finalizing the power of attorney document, the interested party should send document via e-mail (consular@embavenez-us.org) in order to determine consular rights and set up an appointment for signing the document in the Consular Section.

6.3 Revocations and Substitutions

Requirements:

  • The same requirements and costs associated with powers of attorney, whether general or special. Furthermore, a copy of the original power of attorney document to be revoked or substituted must be presented.

6.4 Certified Copies

Requirements:

Certified copies of documents certified by the Consular Section, including power of attorney documents, should be requested in writing. The letter should include the number of the act, papers, book or tome and the date in which the document was awarded. The cost of certified copies is eighty dollars ($80) per document.

Observations:

  • If power of attorney is granted for a business or firm, the original registration and constitutive act of the firm, as well as a photocopy, must be presented.
  • If power of attorney is granted for another person, the original power of attorney must be presented.
  • Every power of attorney relating to minors, social security or marriage is exempt from consular fees.
